Flo – Terms and Conditions
Welcome to Flo by Empire Photography (“we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your use of our photo-to-cinema engine and real estate video conversion services (the “Service”). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
1. Acceptance of Terms
By submitting photos and purchasing a video generation, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.
2. User Content and Copyright Warranty
A core requirement of our Service is that you retain full responsibility for the content you upload.
Ownership and Rights: You represent and warrant that you own or have secured all necessary licenses, rights, consents, and permissions to use the images you upload to the Service.
Grant of License: By uploading images, you grant Flo by Empire Photography a non-exclusive, royalty-free, worldwide license to use, reproduce, process, and modify these images solely for the purpose of generating your requested video content.
No Infringement: You agree that your content will not infringe or violate the rights of any third party, including copyright, trademark, privacy, publicity, or other personal or proprietary rights.
3. Service Limitations and Specifications
Please review the following operational limitations of the Service before purchase. By proceeding, you explicitly agree to these constraints:
No Revisions: Due to the automated nature of the photo-to-cinema engine, all sales are final. Once a video is generated, we cannot offer revisions, edits, or alterations. You are responsible for ensuring the quality and order of the images you upload prior to submission.
No Audio Provided: The final output provided by Flo by Empire Photography is a video file without audio. We do not provide music tracks, voiceovers, or sound effects. You acknowledge that it is your responsibility to add audio using the tools provided by your chosen social media platforms (e.g., Instagram, TikTok) or other third-party software.
Automated Processing: The Service uses algorithms to convert static images into video. While we strive for high quality, you acknowledge that the artistic style, transitions, and pacing are determined by the automated engine and cannot be manually adjusted.
4. Payments and Refunds
Pricing: Prices for the Service are displayed at the time of purchase. We reserve the right to change pricing at any time.
No Refunds: As the Service provides immediate access to digital goods and utilizes computing resources upon submission, all payments are non-refundable. Exceptions are made only in the event of a technical failure on our end that prevents the delivery of the file.
5. Intellectual Property
Our IP: Flo by Empire Photography, including its software, algorithms, code, design, and logos, is the exclusive property of Empire Photography. You are granted a limited, non-transferable right to use the Service for its intended purpose.
Your Deliverable: Upon full payment, you own the final video file exported by the Service for your personal or commercial real estate marketing use.
6. Limitation of Liability
To the fullest extent permitted by law, Flo by Empire Photography shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with:
Your access to or use of (or inability to access or use) the Service.
Any conduct or content of any third party on the Service.
Any unauthorized access, use, or alteration of your transmissions or content.
7. Indemnification
You agree to indemnify, defend, and hold harmless Flo by Empire Photography and its affiliates, officers, directors, and employees from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms (specifically including any claims regarding copyright infringement of uploaded images).
8. Governing Law
